This new evidence is being published now because it was not available until 3rd March 2011. The official court stamp on the transcripts of Expert Witnesses Ivan Formosa and Christopher Farrugia can confirm this.


This is the translation of prosecution witness Ivan Formosa handwriting expert appointed by the court. The translation is as true to the court-recorded transcript as possible. His full report has been published here excluding six pages of detailed information to support his conclusions (will be published in the future). His witness is the most professional of all the prosecution witnesses and the most damming. While the prosecution witnesses (John Dalli, Assistant Commissioner Michael Cassar and Inspector Raymond Cremona) stated there were thousands of letters, other prosecution witnesses had no idea of the amounts.

In his report Ivan Formosa accounts for a total of 1, 671 letters. Mr. Formosa submitted his report to the court on the 14th March 2000. On the 16th March 2000 an article published in the Nazzjon newspaper claimed that 20, 000 letters were in police possession. The next day another article was published confirming that the paper was reliably informed of this and accused the Labour Party of sending the anonymous letters. In his witness, Dalli had suggested that “a large political organisation” could have been involved.

Fingerprint expert PC956 Andrew Caruana always claimed that there were thousands of letters to purposely prolong the proceedings.

In his report Ivan Formosa confirms that all the evidence points to EU Commissioner John Dalli. He COLLUDED with the police and others to frame Joseph Ellul Grech to cover up HIS involvement in THE Daewoo scandal. John Dalli had the motive and resourses to put into action such a despicable and deceitful criminal act.

Forensic Expert Report
Ivan Formosa M.Sc.

States with respect,

1.            On instructions given to me on the 16th November 1999 by Magistrate Dr. Antonio Mizzi the exponent was appointed to conduct forensic examinations to compare Mr. Joseph Ellul Grech’s signature and handwriting with documents that were consigned to him at the Forensic Science Laboratory and report in writing all that is found.

2.                 That the exponent proceeded by taking handwriting samples from Joseph Ellul Grech on the 16th November 1999 between 4:30pm and 7:30pm, also on the 17th November 1999 between 9:30am and 10:45am.

 3.     The exponent collected from the Forensic Laboratory two sacks of “Royal Mail” post blue in which there were 1624 sealed envelopes. The exponent was informed by Mr. Christopher Farrugia that these were passed on to him by assistant commissioner Michael Cassar. A total of another 47 envelopes were deposited from the Forensics Laboratory by inspector Raymond Cremona by PC274. These 47 envelopes were already open.  These were identical envelopes in size and in make. They were size “10” (4 1/8 X 9 ½ ) in white. In the envelopes were three photocopies of size A4 on white paper and folded in three. Because most of the envelopes were sealed precautions were taken to preserve any fingerprints that may have been present with collaboration of the digital imprint expert.

 4.            Also that the exponent had consigned to him from the investigative inspector Raymond Cremona in the presence of assistant commissioner Michael Cassar three pieces of paper with handwriting on them. This was presented as a handwriting sample of Joseph Ellul Grech and Diane Ellul Grech the third piece of paper was from a diary bearing the date 28 Feb.

5.          Also on the 5th January 2000 the exponent had consigned to him from PC824 A. Mercieca: typewriter of the make Silver Reed, model EX44 (BS5850). From this the exponent kept the printwheel (Prestige Pica 10 bearing number 6737) and a ribbon that was inside the typewriter and returned the typewriter back to PC824. Another typewriter of another make Imperial 2000 was returned to PC824 after a typeface sample was taken from it.

6.                  The examination on the typewriter ribbon produced the following results: 




7                       The exponent is of the opinion that there were not sufficient indications that could lead to the conclusion that the typewriters that were examined were used to produce the contents of photocopies in the envelopes.

8             Also there was an examination with ESDA so that it could be determined if there were any imprints of other handwritings in the content of over one hundred (100) envelopes. These all gave negative results and the exponent felt that it was not practical that further ESDA examinations be carried out. The court was informed about this. 

9.                      The procedure adopted for document comparison in reaction is based on the“Standard Guide for Examinations of Handwriting Items” published by Scientific working Group for Document of the FBI found attached to this).

10.           Handwriting comparison for Joseph Ellul Grech compared with the handwriting on the envelopes.

a.       Joseph Ellul Grech’s sample is fluid and consistent. This indicates and reflects that it is the author’s normal handwriting. The exponent is of the opinion that the handwriting has divers’ characteristics that individualize the author. 

b.    The handwriting on the envelopes does not show any signs of “distortion” and it is probable that it reflects the author’s normal handwriting .On these letters it is found different category of handwritings (script, capital, block) therefore the envelopes were classified as long as there was consistency in the handwriting on the envelopes as classified. The envelopes classified indicate that the handwriting on the envelopes is that of more than one person

c         In Joseph Ellul Grech’s handwriting is found some characters that are very similar to the handwriting on the envelopes, however there are others that do not match. The exponent is of the opinion that the similarities that exist between the characters are less significant from the lack of similarities that are found. In other words there are more significant characters that do not match with those of Joseph Ellul Grech from the number of those that match. 

d.       The amount of natural handwriting variations on the envelopes and the handwriting sample of Joseph Ellul Grech have a substantial amount of significant differences; and no limitations are found to associate with missing characters, personal author’s characteristics, or a handwriting quantity disposable for comparison.

“The range of variations exhibited in the questioned writing and in the known writing contains substantial significant dissimilarities; and no limitations associated with the absent characters, individualizing characteristics, or quantity of writing are present. There may be absent characters. There may be similarities. “(Standard Guide for the Examination of handwriting Items, published by Scientific Working Group for Documents for the FBI, July 2000).

11. Comparison between letters.

a.      The exponent is of the opinion that the natural handwriting variation that exists on all the envelopes together is far too large for handwriting comparisons of Joseph Ellul Grech. Due to this the exponent compared these letters between them.

   b.      Subsequently, the envelopes were provisionally categorized according to the type of handwriting. With this method, the contents of every category had a natural variation less than that taken globally.

    c.       From this the exponent is of the opinion that the handwriting belong to more than one person and no less than three persons. 

12. Also that the exponent compared again the handwriting of Joseph Ellul Grech with all categories and the similarities were less.

13. The exponent is of the opinion that no part of the handwriting on the envelopes was written by Joseph Ellul Grech or with the documents that the investigating inspector presented to the exponent as a handwriting sample.

14. The exponent is exhibiting with this reaction the handwriting samples that were examined and numbered from HS1 to HS13.
